Working through the
backlog of complaints has been a priority for several years, and significant
resources have been devoted to this initiative. This effort has paid off: the
backlog has been eliminated and we have shaved more than four months off the average age
of complaints files. We are proud to announce that we have reached a record for files closed
in one year and have the lowest number of open complaint files since 2009.

Dr. Rokshana
Chherawala has admitted that she engaged in professional misconduct involving
several patients. Her admissions include: billing for management of oral
disease when no disease was diagnosed; billing for treatment other than what
was provided; billing for unnecessary treatment that had no clinical benefit; providing
substandard treatment; improper delegation to a dental hygienist by regularly
permitting the hygienist to make a diagnosis through the use of the Velscope;
and failing to maintain adequate dental records. The investigation of the
complaint resulted in a citation (notice of hearing) but the hearing was
avoided when the Inquiry Committee accepted the consent agreement submitted by
Dr. Chherawala to address the College’s concerns.

It is important that registrants and the public understand how the College investigates complaints. We have updated this section of the website with an interactive infographic (the content appears as the user scrolls down the page) that takes you through each step of the complaints and discipline process.

Practice Tip #7: CDA certification and misdelegation of duties (Dr. Sigrid Coil)
There have been a few
cases in which non-certified dental assistants have been employed as certified
dental assistants. This places the dentist at risk of misdelegation of duties.
In this practice tip, Dr. Coil talks about a practice that hired a non-certified
dental assistant, and how dentists can ensure that their CDAs have the proper
qualifications to perform the duties of a CDA and are certified with the
College.
Practice Tip #8: Transfer of Records (Dr. Meredith Moores)
The refusal of a dental office to
provide patient records is a common theme in complaints made to the College. In
this practice tip, Dr. Moores discusses the appropriate protocol for
transferring patient files between practices.
